These Europcar specific terms apply to all rentals that commence in Australia. They contain the Europcar Terms and Conditions for rental of the vehicle (in paragraphs 1 to 14 below) and the Roads and Maritime Services Terms and Conditions which include an obligation to pay Roads and Maritime Services a service fee of $3.30 (incl GST) for each calendar day on which you use an Australian toll road in addition to applicable tolls. The Europcar Terms and Conditions and the Roads and Maritime Services Terms and Conditions apply to all rentals in Australia and may change between online booking and the start of rental. All bookings are also subject to availability on the day of pick up.
1.1 This Contract (Rental Contract) You have entered into with Europcar comprises the rental document for the hire of the Vehicle (Rental Agreement) and these terms and conditions of rental (Terms and Conditions). When We refer to the Rental Contract We mean both the Rental Agreement and the Terms and Conditions.
1.2 The date of the Rental Contract is the date that is shown in the Rental Agreement.
1.3 Please read the Rental Contract carefully. If there is anything that You do not understand please ask at the Rental Station before signing the Rental Contract, as Your signature is Your acknowledgement that You have read and understood the Rental Contract in its entirety and that You are bound by it.
1.4 There are words and phrases used in the Rental Contract that have a particular meaning that You need to be familiar with.
Accident means an unintended, unforeseen, happening, incident or mishap, which is neither expected nor designed.
Administration Fee means the fee charged by Us for the administrative costs associated with Your rental.
Authorised Driver means any driver approved and recorded by Us, either on the Rental Agreement or by prior written agreement.
Commercial Vehicle means a Vehicle that is a van, utility, truck or bus that is constructed and used for the carriage of goods or property or for the transport of more than 12 persons including the driver.
Cover Products means Super Peace of Mind (SPOM), Super Collision Damage Waiver (SCDW), Peace of Mind (POM), Collision Damage Waiver (CDW), Loss Damage Waiver (LDW) and Windscreen Headlight and Tyre Puncture (WWI).
Customer Own Insurance means that You have a Corporate Services Agreement with Us under which Your Rental Contract provides no cover for Damage or Third Party Loss arising from the use of the Vehicle. All Damage and Third Party Loss is then Your sole responsibility and must be paid in full by You. Further, You indemnify Us for all Damage or Third Party Loss.
Damage means any loss or damage to the Vehicle, including that caused by hail, theft of the Vehicle, towing and salvage fees, assessing fees or Loss of Use.
Damage Liability Fee (DLF) means the amount payable to Us in the event of Damage or Third Party Loss. The maximum amount payable is shown in the Rental Agreement and is subject to GST.
Debit Card means Debit MasterCard or Visa Debit Card.
Europcar means CLA Trading Pty Ltd ABN 81 082 220 399 trading as Europcar Australia "the owner" on the Rental Agreement or where applicable an independent Europcar licensee.
Final Inspection means the inspection carried out after We have taken possession of and fully examined and cleaned the Vehicle at the end of the Rental Period.
Loss of Use means the fee calculated at the daily rate shown in the Rental Agreement being Our loss because the Vehicle needs repair and We are waiting for the repairs to be completed or it is a write-off or has been stolen and We are waiting for it to be replaced.
Off Road means any area that is not a gazetted road nor a sealed road nor an Unsealed Road and includes but is not limited to unformed roads, fire trails, tracks, river and tidal crossings, creek beds, beaches, streams, dams, rivers, flood waters, sand, deserts, rocks, fields and paddocks.
Overhead Damage means:
(a) Damage at or above the level of the top of the front windscreen of the Vehicle;
(b) Damage to any part of the pantech or box section of a Commercial Vehicle; or
(c) Third Party Loss,
caused by:
(i) contact between the part of the Vehicle that is at or above the level of the top of the front windscreen with objects overhanging or obstructing its path;
(ii) use of a Commercial Vehicle so that its height exceeds that permitted by law, by-law, regulation or advisory sign in the area of use;
(iii) objects being placed on the roof of the Vehicle; or
(iv) You or any person standing or sitting on the roof of the Vehicle.
Premium Location Surcharge (PLS) means the extra amount payable to Us when a Vehicle is hired from a premium location. The amount is shown in the Rental Agreement, is subject to GST and is adjusted when a DLF and, if applicable, an SVALF are payable.
Rental Charges means all rental and associated charges plus GST or other taxes and levies required by law and credit card and vehicle registration recovery fees, all shown in the Rental Agreement.
Rental Station means the branch or rental location from which You hired the Vehicle.
Rental Period means the period shown in the Rental Agreement or as extended by Us.
Single Vehicle Accident means an Accident that occurs on an Unsealed Road where Unsealed Road Cover - 4WD or Unsealed Road Cover - ALWD have been purchased and the Accident does not involve an impact between the Vehicle and another moving vehicle. It includes but is not limited to:
(a) impacts with animals, roadside infrastructure, vegetation, rocks and obstacles;
(b) rollovers; or
(c) impacts with any stationary object, including other stationary parked vehicles.
Single Vehicle Accident Liability Fee (SVALF) means the amount payable to Us in the event of Damage or Third Party Loss arising from a Single Vehicle Accident and applies only if You have purchased Unsealed Road Cover - 4WD or Unsealed Road Cover - ALWD. The maximum amount payable is shown in the Rental Agreement, is additional to the DLF and is subject to GST.
Snow Cover means the additional cover that allows the Vehicle to be driven on sealed roads above the Snow Line.
Snow Line means the gates leading to any of the national parks or snowfields in Australia between 1 June and 31 October, or any area where it is indicated or required that snow chains are to be fitted to the Vehicle.
Start of Rental means the date and time that the rental commences at the Rental Station shown in the Rental Agreement.
Third Party Loss means any loss or damage to third party property, including other motor vehicles, and any third party claim for loss of income or consequential loss.
Underbody Damage means any damage to the underside of the Vehicle and includes but is not limited to all parts of the drive train, chassis, steering, suspension, brakes, exhaust, floor pan and fuel systems.
Unsealed Road means a road that has been formed and constructed but is not sealed with a hard material such as tar, bitumen or concrete.
Unsealed Road Cover - 4WD means the additional cover that allows some classes of Vehicle to be used on an Unsealed Road provided that the road is gaztetted but it never allows the use of the Vehicle Off Road.
Unsealed Road Cover - ALWD means the additional cover that allows some classes of Vehicle to be used on an Unsealed Road provided that the road is gazetted and graded and maintained by a local, state, territory or government body, authority or council but it never allows the use of the Vehicle Off Road.
Vehicle means the vehicle described in the Rental Agreement and includes its parts, components, accessories, audio equipment and tools or any vehicle substituted by Us pursuant to the Rental Contract.
We, Us, Our means Europcar or one of its franchisees or affiliates as shown in the Rental Agreement.
You, Your means the person, firm, company or organisation renting the Vehicle or any Authorised Driver shown in the Rental Agreement.
Your Europcar Account means Your credit card, Europcar charge account or Debit Card nominated at the Start of Rental for the debiting of charges under the Rental Contract.
2.1 Your rental of the Vehicle from Us is for the Rental Period and at the rate shown in the Rental Agreement.
2.2 The Vehicle must be returned to the Rental Station on the date and by the time shown in the Rental Agreement.
2.3 We understand that circumstances change and that You may require the Vehicle for longer than the Rental Period. If so, You must notify Us at least 2 hours prior to the expiration of the Rental Period.
2.4 If We have agreed to an extension of the Rental Period and Your extended Rental Period is longer than 30 days, Youmust take the Vehicle to Your nearest Europcar rental station on day 29 and every 30 days thereafter to pay Your additional Rental Charges for the extended Rental Period unless You have Our prior written agreement varying these conditions.
2.5 If You fail to notify Us at least 2 hours before the expiration of the Rental Period that You require an extension, We may:
(a) terminate the Rental Contract; and
(b) recover the Vehicle by lawful means.
2.6 A ‘No Show' fee may apply if You fail to notify Us of Your intended cancellation prior to the date and time of the commencement of Your reservation.
2.7 We reserve the right to substitute a suitable replacement vehicle at any time.
3.1 At the Start of Rental You must provide Your credit card or Debit Card which We may pre-authorise as security to pay Your Rental Charges. Payment by Debit Card is not acceptable on all Vehicles and You should check with the Rental Station that Your proposed means of payment is acceptable to Us before signing the Rental Contract.
3.2 When collecting the Vehicle the primary cardholder must be present.
3.3 At the end of the Rental Period You must pay Us:
(a) the Rental Charges;
(b) all reasonable costs to return the Vehicle to the same condition it was in at the Start of Rental including but not limited to extra cleaning; and
(c) any amounts payable under clauses 3.8, 3.9, 4.6 and 4.7.
3.4 If there is Damage or Third Party Loss You must pay Us:
(a) the DLF; and
(b) the SVALF where Unsealed Road Cover - 4WD or Unsealed Road Cover - ALWD have been purchased and a Single Vehicle Accident has occurred,
unless Your Rental Contract is for Customer Own Insurance in which case You are liable for all Damage or Third Party Loss.
3.5 If the DLF and, where applicable, the SVALF are payable under clause 3.4 but there is no Third Party Loss:
(a) upon return of the Vehicle to the Rental Station We may make an estimate of Damage and charge Your Europcar Account the estimated amount up to but not exceeding the DLF and, where applicable, the SVALF shown in Your Rental Agreement; and
(b) once Damage has been assessed We will:
(i) debit Your Europcar Account with the difference up to a total amount not exceeding the DLF and SVALF shown in Your Rental Agreement; or
(ii) credit Your Europcar Account with the difference,
and forward to You a tax invoice for the assessed amount.
3.6 If You have not paid the DLF and SVALF as required by clauses 3.4 and 3.5 You are in breach of the Rental Contract. You then have no cover and are liable for each of the items and amounts payable under clause 4.7.
3.7 The Vehicle is supplied with a full tank of fuel. If You do not take the "prepaid fuel" option and return the Vehicle without a full tank of fuel a refuelling charge will apply. You must also pay for any fuel used for the delivery and collection service.
3.8 Roads and Maritime Services ABN 76 236 371 088 (RMS) provides an E-toll facility for payment of tolls incurred by You when driving the Vehicle on a toll road and You must pay RMS in connection with Your use of the E-toll facility:
(a) all tolls incurred in connection with Your use of a toll road;
(b) a service fee of $3.00 plus GST for each calendar day on which a toll is incurred using Your E-toll facility (of which $1.50 plus GST is remitted to Us by RMS); and
(c) any other amount that is payable pursuant to the Roads and Maritime Services Terms and Conditions.
3.9 You are liable for and must pay:
(a) speeding and traffic fines, infringements and penalties arising from the use of
the Vehicle;
(b) fines, infringements and penalties arising from parking, clamping, towing, or
release of the Vehicle from compounds; and
(c) all court fees or costs arising from sub-clauses (a) or (b),
whether You were driving the Vehicle or not.
3.10 We may supply Your details to any regulatory authority upon its request and an administrative fee applies if We do. If We have paid any amount for which You are liable pursuant to clauses 3.8 or 3.9 You will also be charged that amount together with an administrative fee.
3.11 All amounts payable under the Rental Contract are subject to subsequent verification and adjustment and details of any adjustments will be provided to You as soon as practicable. If a refund is due to You it will be credited to Your Europcar Account. If any amount is due to Us You authorise Us to charge Your Europcar Account with that amount, including the DLF, the SVALF and any amounts payable under clauses 3.8, 3.9, 4.6 or 4.7. These charges may be made at any time during or after the end of the Rental Period.
3.12 If currency conversion is required for payment of amounts due to Us under the Rental Contract, We will apply the commercial exchange rate valid at the time We credit or debit Your Europcar Account.
3.12 If You fail to pay Us any amount due under the Rental Contract You must also:
(a) pay Us interest on that overdue amount calculated at the rate of 10% per annum and starting 7 days after the date that overdue amount became payable to Us and ending on the date of payment of all amounts due; and
(b) pay the reasonable costs and charges We incur in recovering or attempting to recover that overdue amount, including mercantile or debt collection fees, commission and any legal costs.
4.1 The DLF and, if applicable the SVALF, each shown in the Rental Agreement must be paid if there is Damage or Third Party Loss unless Your Rental Contract is for Customer Own Insurance in which case You are liable for all Damage or Third Party Loss.
4.2 If Cover Products are purchased to reduce Your liability We will provide cover for Damage or Third Party Loss but Youmust pay the reduced DLF shown in the Rental Agreement.
4.3 The DLF and SVALF shown in the Rental Agreement are payable for each separate event and whether You are at fault or not.
4.4 The Rental Contract provides no cover for personal property owned by You, any unauthorised driver or any passenger even if Cover Products have been purchased.
4.5 If there is Damage or Third Party Loss and You have purchased:
(a) SPOM, which is Our premium cover, Your DLF liability is reduced to the amount shown in the Rental Agreement, which for some classes of Vehicle may be nil, and it includes WWI;
(b) SCDW, Your DLF liability is reduced to the amount shown in the Rental Agreement, which for some classes of Vehicle may be nil, but it does not include WWI;
(c) POM, Your DLF liability is reduced to the amount shown in the Rental Agreement , but never to nil and it includes WWI;
(d) LDW or CDW, Your DLF liability is reduced to the amount shown in the Rental Agreement but never to nil and it does notinclude WWI;
(e) WWI, there is cover for windscreen, headlight, wheel and tyre damage unless caused recklessly or by a deliberate, wilful or criminal act or by driver abuse, but there is no reduction in Your DLF and no cover for damage to side and rear windows,
and each level of cover is subject to You not being in breach of the Rental Contract.
4.6 You must always pay and there is no cover for:
(a) the DLF if there is Damage or Third Party Loss;
(b) the SVALF if You have purchased Unsealed Road Cover - 4WD or Unsealed Road Cover - ALWD and there is Damage or Third Party Loss caused by a Single Vehicle Accident;
(c) the cost of rectifying windscreen, headlight, wheel or tyre damage unless You have purchased SPOM, POM or WWI;
(d) Damage or Third Party Loss that occurs whilst a Commercial Vehicle is being driven in reverse;
(e) Damage that is caused to a Vehicle with a convertible roof by overfilling the luggage compartment above the recommended level, and then activating the convertible roof mechanism;
(f) Overhead Damage;
(g) Damage or Third Party Loss caused deliberately or recklessly by You, any unauthorised driver or any passenger of the Vehicle;
(h) Underbody Damage and any Damage linked to that Underbody Damage caused by contact between the underside of the Vehicle and any part of the road way or any object or obstruction including but not limited to kerbs, gutters, speed or road humps, barriers or wheel stops;
(i) Damage caused by total or partial inundation or immersion of the Vehicle in water or exposure of the Vehicle to salt water, including that which occurs whilst the Vehicle is being transported;
(j) Damage or Third Party Loss caused or contributed to by You or any driver where You or the driver leaves the scene of the Accident prior to the attendance of the police or reporting the Accident to the police;
(k) the full cost of replacing or repairing any accessories supplied by Us including, but not limited to child restraints and GPS units and lost keys;
(l) Damage caused by use of the incorrect fuel type;
(m) Damage or Third Party Loss if the Vehicle is taken into any area prohibited by the Rental Contract;
(n) property that is stolen from the Vehicle, lost or damaged during the Rental Period or left in the Vehicle after the Vehicle is returned to the Rental Station;
(o) loss or damage to Your property, the property of a member of Your immediate family or of an entity related to You, that arises from the use of the Vehicle; or
(p) Damage or Third Party Loss if Your Rental Contract is for Customer Own Insurance.
4.7 If You or any driver whether authorised by Us or not breach the Rental Contract there is no cover and You and any driver are each liable for:
(a) Damage;
(b) Third Party Loss;
(c) storage, repossession and recovery fees;
(d) roadside assistance; and
(e) administrative and legal costs of recovery,
even if Cover Products have been purchased.
5.1 If You have a Corporate Services Agreement with Us that provides for Customer Own Insurance and if Your Rental Agreement records that Your Rental Contract is for Customer Own Insurance:
(a) all Damage and Third Party Loss arising from the use of the Vehicle is Your responsibility and must be paid in full by You; and
(b) You fully indemnify Us for:
(i) Damage or Third Party Loss; and
(ii) any demand, claim, including a claim for legal costs, action or proceeding made, commenced or issued by or against You,
that arises from the use of the Vehicle.
6.1 In this section, We set out the responsibilities You have to Us when You hire one of Our Vehicles. You should be aware that a failure to fulfill any of these responsibilities is a breach of the Rental Contract with the consequences that are set out in clause 4.7.
6.2 The Vehicle must only be driven by You.
6.3 You must:
(a) be no less than 21 years of age and additional charges will apply for specific vehicles and drivers under the age of 25;
(b) hold a full, current, unrestricted driving licence for the Rental Period valid for the Vehicle and which is written in English or an international licence translated into English;
(c) allow Us to inspect Your licence at any time during the Rental Period;
(d) fully inspect the Vehicle at the Start of Rental to ensure the condition of the Vehicle and any pre-existing damage is accurately noted and shown in the Rental Agreement. If there is any discrepancy You must notify Us prior to leaving the Rental Station; and
(e) tell Us if You will be using the Vehicle to drive interstate.
6.4 During the Rental Period You must:
(a) take all reasonable care of the Vehicle:
(i) to prevent Damage or Third Party Loss;
(ii) to ensure that the Vehicle is not overloaded by the number of persons or by the weight of goods carried;
(iii) by using any security device fitted to or supplied with the Vehicle; and
(iv) by protecting the Vehicle against inclement weather;
(b) keep the Vehicle locked and the keys under Your personal control at all times and You must be able to produce those keys in the event of a theft of the Vehicle;
(c) maintain all of the Vehicle's engine and brake oils, engine coolant levels and tyre pressures;
(d) use the correct fuel type;
(e) comply with all seat belt laws and fines may be imposed on any driver or passenger who does not have a seat belt properly adjusted and fastened;
(f) comply with all child restraint laws and ensure that for all children under the age of seven years the restraint has been fitted correctly according to the weight and age of the child and that the restraint is properly adjusted and fastened;
(g) return the Vehicle and any accessories supplied by Us including, but not limited to, child restraints and GPS units in the same condition as at the Start of Rental;
(h) adhere to any mileage instructions displayed in the Vehicle or set by the Rental Station; and
(i) immediately upon request provide Us and any regulatory authority Your full, accurate and up-to-date information relating to the use of the Vehicle during the Rental Period.
6.5 You must never:
(a) use the Vehicle when it is damaged or unsafe;
(b) drive the Vehicle whilst under the influence of alcohol or drugs or have a blood alcohol content or level of drugs present in blood, urine or oral fluid that exceeds the limit in the state or territory where the Vehicle is driven;
(c) fail or refuse to undergo any breath, blood, oral fluid or urine test or drug impairment assessment in the state or territory in which the Vehicle is driven;
(d) drive the Vehicle whilst Your driving licence is subject to any restriction or condition;
(e) commit:
(i) any wilful, deliberate or criminal act, including an act of driver abuse; or
(ii) an act of connivance with any person acting for You or on Your behalf, that causes Damage or Third Party Loss;
(f) drive the Vehicle dangerously or recklessly;
(g) use a mobile phone or a GPS unit whilst the Vehicle is in motion or stationary but not parked unless the body of the phone or GPS unit is affixed to the Vehicle and the phone or GPS unit is not being held or touched at any time whilst being used;
(h) leave the keys to the Vehicle in it or with it whilst it is unattended or unoccupied by You or any passenger;
(i) leave the Vehicle unattended following an Accident and before the arrival of a tow or salvage operator;
(j) modify the Vehicle in any way and no roof racks or towbars are permitted unless fitted by Us;
(k) use the Vehicle for carriage of passengers or property for hire, fare or reward unless the Vehicle is a Commercial Vehicle and You have Our prior written authority;
(l) use the Vehicle for off-roading, reliability trials, contest, speed testing, driving instruction, to propel or tow another vehicle, in violation of any legislation, order or regulation affecting the use, loading or condition of the Vehicle, or for any illegal purpose;
(m) use the Vehicle for transporting any animals, unless specifically approved by Us. Additional cleaning charges may apply and will be shown in the Rental Agreement; or
(n) sell, rent or dispose of the Vehicle.
6.6 You and any passengers must not smoke in the Vehicle. It is an offence in some Australian states to smoke in a vehicle where there are passengers of less than 18 years of age. Additional cleaning charges will apply if there is a breach of this condition.
6.7 Parts of Australia are not suitable for access by rental vehicles. To prevent damage to the Vehicle and for Your own personal safety We strictly enforce conditions that restrict Your use of the Vehicle.
6.8 Unless We have given Our prior written consent, You must never take the Vehicle:
(a) on any Unsealed Road unless Unsealed Road Cover - 4WD or Unsealed Road Cover - ALWD has been purchased; or
(b) above the Snow Line unless Snow Cover has been purchased.
6.9 You must never take the Vehicle:
(a) Off Road;
(b) between mainland Australia and Tasmania in either direction;
(c) onto any island that is off mainland Australia or Tasmania, with the exception of:
(i) Kangaroo Island;
(ii) Stradbroke Island;
(iii) Magnetic Island;
(iv) Bribie Island; or
(v) Phillip Island;
(d) through any river, stream, creek or tidal crossing;
(e) through flood waters or on flood prone roads or on any road where the state or condition of the road make the use of the Vehicle unsafe;
(f) on any road where the police or any government or statutory authority has issued a warning, caution or which has been closed;
(g) onto any road where We have notified You that the use of the Vehicle is prohibited;
(h) in Queensland:
(i) north of Chillagoe or west of Georgetown;
(ii) north of Cooktown or Laura;
(iii) on the Burke Development Road;
(iv) north of Maggieville;
(v) on Unsealed Roads north and west of Mt Isa;
(vi) on the Bloomfield track; or
(vii) on the Savannah Way;
(i) on the Tanami Track and the Gunbarrel Highway in Western Australia and the Northern Territory; or
(j) on the road from Jim Jim Falls to Twin Falls in the Northern Territory,
even if Unsealed Road Cover - 4WD or Unsealed Road Cover - ALWD has been purchased.
6.10 There are other prohibited areas where You must never take the Vehicle:
(a) in Western Australia:
(i) on the Gibb River Road;
(ii) on the Cape Leveque Road;
(iii) on the road to Windjana Gorge;
(iv) on the Cardabia - Ningaloo Road; or
(v) on the access road from the Great Northern Highway to the Purnululu National Park, commonly known as the Bungle Bungles;
or
(b) in the Northern Territory on the Larapinta and Namitjira Drives, commonly known as the Mereenie Loop,
unless the Vehicle is a 4WD and You have purchased Unsealed Road Cover - 4WD and You have hired a second spare wheel from Us.
7.1 When You make a reservation with Us We will provide a Vehicle that is in good working order for the Rental Period.
7.2 If the Vehicle breaks down during the Rental Period because of Our negligence or wilful default, We will recover and repair the Vehicle as soon as possible. If the Vehicle cannot be repaired, We will use Our best endeavours to provide a replacement Vehicle of an equivalent size and standard to the previous Vehicle for the remainder of the Rental Period.
7.3 If it is not possible to conduct an inspection of the Vehicle with You at the end of the Rental Period, We will use Our best endeavours to confirm the condition of the Vehicle with You within 4 working hours of the Final Inspection.
7.4 We are only responsible for any direct loss that You suffer as a result of Our breach of the Rental Contract. We are not responsible for missed flights, disrupted travel or holiday plans, loss of enjoyment or opportunity, indirect or consequential loss.
8.1 Inherent mechanical faults in the Vehicle receive free roadside assistance.
8.2 Fees and charges apply for all other faults or driver induced errors, including but not limited to:
(a) incorrect refuelling;
(b) a flat battery;
(c) lost keys;
(d) keys locked in the Vehicle; or
(e) tyre changing other than as a result of a tyre puncture.
8.3 We reserve the right not to replace the Vehicle if it is involved in a major Accident or there has been major Damage or You have breached the Rental Contract.
8.4 If:
(a) a warning light appears;
(b) You see or become aware of low engine or brake oils, engine coolant levels or tyre pressures; or
(c) the Vehicle develops any fault during the Rental Period,
You must inform Us immediately via the contact details in the Vehicle and in the Rental Agreement and not use the Vehicle unless We have authorised You to do so. If You fail to notify Us and continue to use the Vehicle You will be responsible for any Damage or Third Party Loss.
8.5 You must not let anyone work on the Vehicle or arrange or undertake any repairs to the Vehicle or towing or salvage of it unless We have given You Our prior authority. You must keep and produce to Us the original tax invoices and receipts for any repairs, towing or salvage and You will be reimbursed only if these expenses have been authorised by Us. Any entitlement to reimbursement is subject to there being no breach of the Rental Contract.
8.6 You must immediately report any Accident or theft of the Vehicle to Us in writing and complete all documentation that We require and forward any third party correspondence or court documents to Us within 7 days of receipt.
8.7 If You have an Accident in which:
(a) a person is injured;
(b) the other party failed to stop or exchange details;
(c) the Vehicle or any other vehicle is towed; or
(d) a driver appears to be under the influence of intoxicating
liquor or drugs,
a report must also be made to the police immediately.
8.8 If the Vehicle is stolen a report must be made to the police immediately the theft is discovered.
8.9 If You have an Accident You must also:
(a) make the Vehicle secure;
(b) get the names and addresses of all persons involved, including witnesses;
(c) supply Us with any information concerning the driver of the Vehicle and You must allow Us direct access to the driver of the Vehicle and You must fully co-operate in allowing Us to gain such access;
(d) not make or give any offer, promise of payment, settlement, waiver, release, indemnity or admission of liability;
(e) permit and assist Us to bring, defend, enforce or settle any legal proceedings against a third party, including attending at a lawyer's office and/or court; and
(f) allow Us to claim in Your name under any applicable substitute vehicle insurance, and do everything that may be required to assist Us in making such a claim.
9.1 At the end of the Rental Period, in addition to Your obligations under clauses 3.3, 3.4 and 3.5, You must return the Vehicle to Us:
(a) to the Rental Station;
(b) in the same condition it was in at the Start of Rental; and
(c) at the date and time set in the Rental Agreement.
9.2 We allow a grace period of 30 minutes for the return of the Vehicle but if it is returned to Us more than 30 minutes after the time set for its return in the Rental Agreement You will be charged one full day's extra rental. Standard daily rates will apply if the Vehicle is returned to Us more than 24 hours after the time set for its return in the Rental Agreement unless the Rental Contract has been extended by Us. You will also be liable for any repossession charges, Damage or Third Party Loss or any costs We incur.
9.3 If You return the Vehicle to a rental station other than that shown in the Rental Agreement, or when the Rental Station is closed, or any place other than a Europcar rental station:
(a) a one way fee may apply;
(b) You will be deemed to have returned the Vehicle only after the Final Inspection of it has been conducted by Us; and
(c) the Rental Charges will continue and You will be responsible for Damage and Third Party Loss until that Final Inspection.
9.4 If a bond has been prepaid to Us it is fully refundable to You provided that at the end of the Rental Period:
(a) all amounts due to Us under the Rental Contract have been paid;
(b) the Vehicle has been returned to the Rental Station at the date and time set in the Rental Agreement;
(c) there is no Damage or Third Party Loss;
(d) the interior and exterior are clean;
(e) the Vehicle has a full tank of fuel; and
(f) the Rental Contract has not been breached.
We reserve the right to retain all or part of a bond if there is a breach of any of these conditions.
9.5 If We terminate the Rental Contract it will not affect Our right to receive any money We are owed under the Rental Contract. We can also claim reasonable costs from You if You do not meet any of the requirements of the Rental Contract.
10.1 We may terminate the Rental Contract and take immediate possession of the Vehicle if:
(a) You breach the Rental Contract; or
(b) a reckless breach of road or traffic legislation has taken place.
10.2 If the Rental Contract is terminated by Us You must pay for:
(a) Damage;
(b) Third Party Loss;
(c) storage, repossession and recovery fees;
(d) roadside assistance;
(e) administrative and legal costs of recovery; and
(f) all reasonable costs and charges under the Rental Contract.
10.3 If We have terminated the Rental Contract You give Us permission to access and enter Your premises to repossess the Vehicle without using unreasonable force or causing damage.
11.1 You have rights conferred by consumer legislation and neither this clause nor any other provision of the Rental Contract is intended to exclude, restrict or modify any implied terms or rights You may have under the Competition and Consumer Act 2010 or any other Federal, State or Territory legislation in Australia.
11.2 The laws of the State in which the Rental Station is situated and of the Commonwealth of Australia govern the Rental Contract.
12.1 If You believe there has been an error in Your account or if You have any complaint, Our staff at the Rental Station will help You in every way they can to rectify the error or resolve the complaint. If they are unable to assist You or if Your concerns are not resolved to Your satisfaction You may refer the matter to Our internal dispute resolution (IDR) process.
12.2 Upon receipt of Your referral to IDR Our IDR officer will acknowledge receipt of Your referral and will investigate the matter and try to reach a satisfactory outcome.
12.3 We will advise You of the final outcome of Your IDR referral within 45 days of receipt of that referral and We will use Our best endeavours to do so within 21 days there of.

13.1 We collect and use Your personal information to provide You with the best level of service possible.
13.2 We respect Your privacy so We take all reasonable steps to make sure that Your personal information is accurate and up to date and that it is protected from misuse, unauthorised access or wrongful disclosure.
13.3 Your personal information may be disclosed to related and non-related third parties with whom We have arrangements to protect Your privacy, such as one of Our program partners.
13.4 Your personal information may also be entered into Our centralised database which is managed by Europcar International and may be accessed by personnel, franchisees and licensees within that group, all of which are governed by group rules that protect Your privacy.
13.5 We recommend that You visit Our website www.europcar.com.au where Our privacy policy is comprehensively set out.
14.1 If You agree to make an optional contribution towards Europcar Greenfleet, We will pay the full amount of Your contribution towards that initiative and its administration.
14.2 If You are the holder of a corporate account with Us or if Your Corporate Services Agreement with Us provides for Customer Own Insurance these Terms and Conditions must be read in conjunction with Your signed Agreement.
14.3 If You are a Privilege Loyalty Program member these Terms and Conditions must be read in conjunction with the Terms and Conditions of that program.
As a Privilege Loyalty Program member at the time of rental of Your Vehicle from Europcar You accept these Europcar Terms and Conditions and the Roads and Maritime Services Terms and Conditions (comprising the RMS E-Toll Facility Terms and Conditions and the RMS Privacy Consent and Agreement) including a binding obligation to pay RMS a service fee of $3.30 (incl GST) for each calendar day on which You use a toll road in addition to the payment to RMS of the applicable tolls.
14.4 In the event of any inconsistencies or ambiguity between the terms of Your corporate account, Your Corporate Services Agreement, Your Customer Own Insurance agreement or Your Privilege Loyalty Program these Terms and Conditions will prevail.
Roads and Maritime Services (ABN 76 236 371 088) (RMS), through Europcar as RMS agent, offers an E-Toll Facility to You on these RMS Terms and Conditions which comprise:
• the RMS E-Toll Facility Terms and Conditions; and
• the RMS Privacy Consent and Agreement
At the time of rental of Your Vehicle from Europcar You accept, and agree to be bound by these RMS Terms and Conditions
1. Your E-Toll Facility
(a) Your E-Toll Facility is provided by RMS to You to enable You to pay Tolls and Fees relating to the E-Toll System in accordance with these RMS Terms and Conditions.
(b) In order to use Your E-Toll Facility, You or Your Authorised Driver must travel in an Electronic Tolling Lane.
(c) You are responsible for the acts and omissions of any Authorised Driver, any other person using the Vehicle or any Authorised Representative using or operating Your E-Toll Facility, including for any Tolls and Fees they incur during the Rental Period.
(d) A Tag may be installed in Your Vehicle as part of the E-Toll Facility. The Tag is the property of RMS. You must not use any other tag in the Vehicle or register for any other electronic or video tolling product in relation to the Vehicle. If You use another tag or electronic or video tolling product, You will still be charged Tolls and Fees by RMS under these RMS Terms and Conditions and You may be charged other amounts by the provider of the other tag or electronic or video tolling product used.
2. Payments, fees and charges in connection with Your E-Toll Facility
(a) You must pay the following amounts to RMS in connection with the use of Your E-Toll Facility:
(i). all Tolls (it is Your responsibility to be aware of all Tolls payable in
connection with the use of a toll road);
(ii). the Service Fee for each calendar day on which the Vehicle incurs a Toll
using Your E-Toll Facility;
(iii). a Processing Fee in the circumstances described in clause 5(b);
(iv). a Dishonour Fee in the circumstances described in clause 3(c); and
(v). any other costs reasonably incurred by RMS in enforcing its rights under
these RMS Terms and Conditions, including any fees or charges imposed by a third party on RMS where You have refused or failed to pay any amount under these RMS Terms and Conditions.
(b) You acknowledge that if You fail to pay any Tolls or Fees as required by these RMS Terms and Conditions, RMS may refer that failure to a Credit Reporting Agency.
3. Payment methods and authority
Payment by Nominated Card
(a) If You are using a Nominated Card to pay for the rental of the Vehicle or have otherwise provided a Nominated Card for the payment of Tolls and Fees, You:
(i). promise to RMS that You are authorised to use the Nominated Card to meet Your payment obligations under these RMS Terms and Conditions; and
(ii). authorise RMS to debit amounts from, or credit funds to, the Nominated
Card for Tolls and Fees and other amounts payable to, or from, RMS under these RMS Terms and Conditions.
(b) RMS will debit Tolls and Fees from the Nominated Card as soon as practicable after the relevant Tolls and Fees are incurred or, where applicable, notified to RMS by a toll road operator.
(c) If:
(i). there are insufficient funds available in the Nominated Card to meet Your
payment obligations under these RMS Terms and Conditions; or
(ii). a transaction on the Nominated Card is declined for any reason, save for:
(A) the negligence of, or wilful misconduct by, RMS or any of its officers, employees or agents; or (B) an RMS systems error,
You will be charged a Dishonour Fee by RMS and You (or, if relevant, the Nominated Card Holder) may be charged fees, charges and interest by Your financial institution or, if relevant, the financial institution of the Nominated Card Holder.
(d) You must ensure that You immediately provide RMS with details for an alternative Nominated Card, which can be used to meet Your obligations under these RMS Terms and Conditions, and an authority for RMS to debit the alternative Nominated Card, if:
(i). the existing Nominated Card is cancelled, suspended or is otherwise not
useable; or
(ii). the existing Nominated Card Holder cancels Your authorisation to use the
existing Nominated Card.
Payment by Your RMS Charge Account Holder
(e) If You are using a Europcar Charge Account to pay for the rental of the Vehicle:
(i). You promise to RMS that You are authorised to incur Tolls and Fees and to
have those Tolls and Fees debited to the RMS Charge Account; and
(ii). RMS will issue Your RMS Charge Account Holder with a monthly invoice
recording all Tolls and Fees incurred or, where applicable, notified to RMS by a toll road operator.
(f) You must immediately provide RMS with updated or alternate payment method details if the RMS Charge Account is cancelled or altered or if You are no longer authorised to incur Tolls and Fees on that RMS Charge Account.
4. Errors in charging Tolls and Fees
(a) If RMS incorrectly credits You with, or pays to You, an amount in connection with Your E-Toll Facility RMS may recover that amount from You provided that RMS has given You 10 days prior written notice of its intention to do so.
(b) RMS will pay, within a reasonable time, any refund due to You in connection with Your E-Toll Facility by such method as RMS may reasonably choose.
5. E-Toll Facility Transaction Summary
(a) You may view a Transaction Summary without charge at any time by logging on
to www.myetoll.com.au/europcar.
(b) If You request that RMS provides a Transaction Summary to You, You will be charged the applicable Processing Fee for the method of delivery elected by You (if that method is stated to be available).
6. Lost, stolen or malfunctioning Tags
(a) You must immediately inform Europcar if either of the following occurs:
(i). the Tag is lost or stolen or You become aware that the Tag malfunctions or
is in any way defective; or
(ii). the Vehicle is lost or stolen.
(b) If You inform Europcar that the Tag is malfunctioning or defective, Your E-Toll Facility will still enable You to use the E-Toll System and to pay Tolls and Fees in accordance with these RMS Terms and Conditions and You will continue to be liable for Tolls and Fees.
(c) If the Tag or the Vehicle is lost or stolen and You have immediately informed Europcar, You will not be liable for Tolls and Fees incurred by that Tag or Vehicle from the time that You have informed Europcar.
7. GST
(a) Unless otherwise indicated, all Tolls and Fees are inclusive of GST.
(b) If GST is stated as not to be inclusive, You are liable for any GST payable.
8. General
(a) New South Wales laws govern these RMS Terms and Conditions.
(b) Unless agreed otherwise, if You, an Authorised Driver or Authorised Representative need to notify RMS of any matters or make a request in relation to Your E-Toll Facility, it must be made in writing by mail, email or facsimile. All notice details are contained on www.myetoll.com.au/europcar or You may call
13 18 65. Notification is effective only upon RMS' receipt of written confirmation.
9. Common Terms
Capitalised terms in these RMS Terms and Conditions have the meaning given to them in the Europcar Rental Contract, unless otherwise defined in these RMS Terms and Conditions.
10. Definitions
In these RMS Terms and Conditions except where the context otherwise requires:
"Authorised Representative" means an individual who is 21 years or older and who is authorised by You to use and access Your E-Toll Facility.
"Credit Reporting Agency" means a corporation that carries on a credit reporting business.
"Dishonour Fee" means a fee of $1.15.
"Electronic Tolling Lane" means a Tolling Lane which is designated as permitting the payment of Tolls by electronic means.
"E-Toll Facility" means the facility described in clause 1(a).
"E-Toll System" means the entire system relating to electronic tolling operated by RMS, any operator of a toll road or any Tag Issuer or Pass Issuer.
"Europcar Charge Account" means the charge account established by Your RMS Charge Account Holder with Europcar.
"Europcar Rental Contract" means the agreement entered into between You and Europcar comprising the Rental Agreement and the Europcar Terms and Conditions of Rental.
"Fees" means each of the fees and costs (and any taxes applicable to them) described in clauses 2(a)(ii) - 2(a)(v) inclusive of these RMS Terms and Conditions.
"GST" has the same meaning as in A New Tax System (Goods and Services Tax) Act 1999 (Cth).
"Nominated Card" means a valid credit card or Debit Card nominated by You as the source of payment for all Tolls and Fees.
"Nominated Card Holder" means a person other than You who holds a Nominated Card.
"Pass Issuer" means a toll road operator that uses the E-Toll System and issues, or an entity that does not operate a toll road but issues, passes or other electronic or video tolling products for the purpose of the E-Toll System.
"Processing Fee" means in relation to a Transaction Summary delivered:
(a) by mail, a fee of $5.00; or
(b) by email, a fee of $2.20.
"RMS Charge Account" means the charge account established by Your RMS Charge Account Holder with RMS.
"RMS Terms and Conditions" means these Roads and Maritime Services Terms and Conditions which comprise the "RMS E-Toll Facility Terms and Conditions" and the "RMS Privacy Consent and Agreement".
"Service Fee" means the fee described as such in the Rental Agreement.
"Tag" means the RMS device installed in the Vehicle to enable the payment of Tolls by electronic means.
"Tag Issuer" means a toll road operator who uses the E-Toll System and issues tags, or an entity that does not operate a toll road but issues tags for the purpose of the E-Toll System.
"Toll" means all toll charges or other fees and charges imposed by the operator of a toll road for, or taxes payable in respect of each Trip taken by the Vehicle during the Rental Period.
"Tolling Lane" means a lane on a toll road at a toll collection point.
"Tolls and Fees" means all Tolls and Fees and any other payments, amounts or charges referred to in these RMS Terms and Conditions.
"Transaction Summary" means a summary of the transactions (including the Tolls and Fees incurred) on Your E-Toll Facility.
"Trip" means the driving of a Vehicle past a toll collection point.
"You" or "Your" refers to the person(s) who have agreed to be bound to these RMS Terms and Conditions and with whom the Rental Contract is made.
"Your RMS Charge Account Holder" means the person which has entered into an agreement with RMS for the payment of the Tolls and Fees during the rental of a Vehicle.
11. Interpretation
(a) Headings are for convenience only and do not affect interpretation. Any use of the singular tincludes the plural and the converse applies. A gender includes all genders.
(b) Any reference to dollars and $ is to Australian currency.
(c) A reference to a person includes any type of entity or body of persons, whether or not it is incorporated or has a separate legal identity.
RMS is required to comply with Privacy Laws and other road transport, driver licensing and vehicle registration legislation when dealing with any Personal Information, including E-Toll Information.
This RMS Privacy Consent and Agreement contains consents and promises from You in relation to E-Toll Information collected from You and from third parties to enable RMS and others to collect, use and disclose it for Permitted Purposes. You are not required by law to provide E-Toll Information to RMS, but if You do not, RMS will not be able to provide the E-Toll Facility to You. Your Personal Information will be held by RMS at Level 3, Octagon Building, 99 Phillip Street Parramatta or at any new or additional address or addresses disclosed in RMS' privacy policy from time to time.
RMS' privacy policy, which explains RMS' privacy practices including how to make
an application to access or correct information about You or a complaint, and RMS' complaints handling processes, is available at: http://rms.nsw.gov.au/gipa/privacy/index.html or (02) 8588 4981.
Consents given by You
1. In exchange for RMS providing the E-Toll Facility, You consent to and authorise:
(a) collection of E-Toll Information by any Authorised Information Recipient from any person (including from Europcar and from video and/or camera surveillance of toll roads conducted by RMS or third parties for traffic management or toll violation enforcement purposes);
(b) use and disclosure of E-Toll Information by and to Authorised Information Recipients for the Permitted Purposes;
(c) disclosure of E-Toll Information in online accounts accessible to any person with access to Your Agreement Number and surname; and
(d) disclosure of E-Toll Information to persons outside Australia for the Permitted Purposes on the basis that RMS is not required to ensure that any overseas recipient complies with the Privacy Laws.
Promises made by You
2. You promise that:
(a) prior to disclosing any information to RMS or Europcar about an Individual, You have obtained their consent to the matters in clause 1; and
(b) all information You provide to RMS about You or any Individual is or will be accurate, complete and up-to-date, and will not be false or misleading.
Definitions
"Agreement Number" means a unique agreement number provided to You by Europcar or by RMS in connection with the Rental Contract.
"Associated Contractors" means RMS' suppliers, agents, distributors and contractors in relation to any Permitted Purposes.
"Authorised Information Recipient" means RMS, Europcar, Your RMS Charge Account Holder and each Authorised Driver, Authorised Representative and Intended Recipient.
"Clearing House" means any person who operates a clearing house for operators of toll roads, or Tag Issuers or Pass Issuers or any combinations of these.
"E-Toll Information" means any information relating to You or Your E-Toll Facility, Vehicle, the location of a Tag or Vehicle at any time, the direction of travel, or video and/or camera surveillance operated at toll roads. E-Toll Information may include without limitation Personal Information about:
(a) You; or
(b) any Individual,
including a name, address, phone number, email address, drivers licence number, date of birth, Vehicle hire and usage information, billing or financial information, Rental Contract, Nominated Card, Europcar Charge Account, RMS Charge Account and other Personal Information contained in video and/or camera surveillance of toll roads for traffic management or toll violation enforcement purposes conducted by RMS or obtained by RMS from third parties.
"Individual" means any individual, including any Authorised Driver, Authorised Representative, Nominated Card Holder and Your RMS Charge Account Holder.
"Intended Recipients" means the following parties both within and outside NSW: (i) Credit Reporting Agencies; (ii) Associated Contractors; (iii) Tag Issuers; (iv) Pass Issuers; (v) any bank, financial institution or Clearing House; (vi) RMS' professional advisers including legal advisers, accounting advisers and other professional advisers; (vii) driver licensing and vehicle registration agencies, law enforcement agencies, public revenue authorities, road safety authorities and solicitors in relation to motor vehicle accidents; (viii) owners and other operators of toll roads; and (ix) persons providing services to any of the entities set out in (i) to (viii).
"Permitted Purposes" means any one or more of:
(a) facilitating the use of and carrying out functions and activities relating to: (i) tolls and their enforcement; (ii) the E-Toll System; (iii) any cashback system; (iv) Your E-Toll Facility and Tags; (v) verification of Your Rental Contract (including verifying the details of a Nominated Card Holder or Your RMS Charge Account Holder); (vi) obtaining feedback about the E-Toll System and Your E-Toll Facility; and (vii) analysing information relating to traffic conditions, travel times and road usage and disclosing aggregate information (including to the public);
(b) auditing of the E-Toll System;
(c) law enforcement;
(d) the enforcement of a law imposing pecuniary penalty;
(e) the protection of the public revenue;
(f) road safety;
(g) release of information to solicitors acting as agents for their clients in relation to motor vehicle accidents where RMS is compelled to do so by a court order;
(h) obtaining advice and professional services on a confidential basis;
(i) market research and statistical analysis;
(j) other purposes related or incidental to the purposes listed above; and
(k) such other purposes as are permitted by Privacy Laws,
in each case both within and outside NSW.
"Personal Information" means information or an opinion (including information or an opinion forming part of a database and whether or not recorded in a material form) about an individual whose identity is apparent or can reasonably be ascertained or is reasonably identifiable from the information or opinion and any other information subject to the Privacy Laws.
"Privacy Laws" means the privacy laws which apply to RMS from time to time, including the Privacy and Personal Information Protection Act 1998 (NSW) for so long as it applies to RMS and any other current or future legislation, mandatory codes and policies relating to the handling of Personal Information which apply to RMS.

The payment of the estimated rental price and possible additional charges resulting from damages or loss of the rented vehicle must be guaranteed upon rental according to the following modalities:

Europcar pre-paid vouchers (with specific value or with the indication Gruppo più Giorni) are accepted as means of payment for the rental price, but must be accompanied by a credit card for the amounts that have not been pre-paid (extras, fuel service, sums due in case of damages or theft of the rented vehicle).

Lacking even only one of the above mentioned elements required to guarantee the rental, Europcar will not be able to provide the requested vehicle but, as an alternative, a vehicle belonging to a different category: in any case, no refund is provided for.
Prepaid rates do not comprehend any additional charge which is not expressly considered as included in the Europcar booking confirmation of prepaid rental and do not comprehend any additional service for which the customer might be responsible. At the time of the pick-up of the vehicle, the same valid credit card used in the booking phase and registered in the name of the main driver shall be presented as guarantee for any additional expense anticipated and not covered by the sum deposited as prepaid. The cards accepted in the phase of the pick-up of the vehicle are those belonging to the main networks: DINERS, VISA, MASTERCARD, AMEX. Prepaid, revolving and PayPal cards are not accepted. Visa Electron cards are accepted exclusively if issued by bank networks (no Postepay). Upon pick-up of the vehicle, a bank authorization will be required for blocking the deposit amount. TPL Insurance (mandatory)
TPL - Third Party Liability coverage is a mandatory insurance that the Government traffic regulations require for all drivers in Mexico. The TPL Insurance covers up to $250,000 MXP and is included on the rate quoted in your reservation.
Third Party Liability is car insurance that covers against death and or bodily injury to any third party; in an accident caused by or arising out of the use of the insured vehicle (people inside the car are not covered by TPL, and are only covered if optional Auto Personal Accident insurance has been included in the agreed policy package).
IMPORTANT INSURANCE INFORMATION For travelers resident in foreign countries
Due to this situation, Europcar Mexico strongly recommends that all foreign travelers purchase the optional SLI coverage (Supplemental Liability Insurance) which provides similar or higher coverage amounts for claims and indemnities to the ones you find in your country of residence. The SLI coverage provides up to $1,000,000 USD per event (people inside the car are not covered by TPL, and are only covered if optional Auto Personal Accident insurance has been included in the agreed policy package).
The SLI coverage is separate from the mandatory TPL coverage and is available at an additional charge of $16.99USD per day plus applicable taxes, for all type of vehicles.
If you decline the SLI coverage, you will be covered just by the mandatory TPL insurance with a coverage limit of $250,000 Mexican pesos per event or approximately $22,000 USD.
LDW Insurance
LDW (CDW) - Loss and Damage Waiver is available at $19.99USD per day plus applicable taxes for all types of vehicles. LDW (CDW) reduces the customer's responsibility for all vehicles. In the case of accident or theft the customer is only responsible for paying a 10% deductible (or excess) of 10% of the total value of the car.
The LDW (CDW) is optional and is typically purchased by customers that are not covered for vehicle damage or loss by their credit card company (or insurance linked to a credit card). For your own protection we prefer that all customer present a valid letter or proof of coverage from his credit card issuing institution with a verifiable phone number and/or e-mail address for confirmation, stating that LDW (CDW) coverage is provided by his/her credit card. If such proof can not be produced at time of rental, we will also honor the customer's assertion of coverage. In any event, all customers declining LDW will have to sign a "statement of personal responsibility for the value of the car" should they decline the LDW and wish to be covered by their Credit Card Company. In the event of an accident, a customer having declined LDW will be fully responsible for all damage and/or repairs up to the total value of the car.
A credit card authorisation of $5,000 USD will be performed on the customer's credit card as a guarantee at the beginning of the rental.
Some Premium vehicle types may require an authorisation of up to $10,000 USD (please refer to the category list mentionned here below). If the customer credit card does not have the guarantee previously mentioned the purchase of the LDW (CDW) coverage will be mandatory.

EFFECTIVE FROM APRIL 2012
1.1 This Contract (Rental Contract) You have entered into with Europcar consists of the rental document You have signed for the hire of the Vehicle (Rental Agreement) and these terms and conditions of rental (Terms and Conditions). When We refer to the Rental Contract We mean both the Rental Agreement and the Terms and Conditions.
1.2 The date of the Rental Contract is the date that is shown in the Rental Agreement.
1.3 Please read the Rental Contract carefully. If there is anything that You do not understand please ask at the Rental Station before signing the Rental Contract, as Your signature is Your acknowledgement that You have read and understood the Rental Contract in its entirety and that You are bound by it.
1.4 There are words and phrases used in the Rental Contract that have a particular meaning that You need to be familiar with.
Accident means an unintended, unforeseen, happening, incident or mishap, which is neither expected nor designed.
Authorised Driver means any driver approved and recorded by Us, either on the Rental Agreement or by prior written agreement.
Commercial Vehicle means a Vehicle that is a van, utility, truck or bus that is constructed and used for the carriage of goods or property or for the transport of more than 12 persons including the driver.
Cover Products means Super Peace of Mind (SPOM), Super Collision Damage Waiver (SCDW), Peace of Mind (POM), Collision Damage Waiver (CDW), Loss Damage Waiver (LDW) and Windscreen Headlight and Tyre Puncture (WWI).
Customer Own Insurance means that You have a Corporate Services Agreement with Us under which Your Rental Contract provides no cover for Damage or Third Party Loss arising from the use of the Vehicle. All Damage and Third Party Loss is then Your sole responsibility and must be paid in full by You. Further, You indemnify Us for all Damage or Third Party Loss.
Damage means any loss or damage to the Vehicle, including that caused by hail, theft of the Vehicle, towing and salvage fees, assessing fees or Loss of Use.
Damage Liability Fee (DLF) means the amount payable to Us in the event of Damage or Third Party Loss. The maximum amount payable is shown in the Rental Agreement and is subject to GST.
Debit Card means Debit MasterCard or Visa Debit Card.
Europcar means BVJV Limited GST Number 80-610-270 trading as Europcar New Zealand "the owner" on the Rental Agreement or where applicable an independent Europcar licensee.
Final Inspection means the inspection carried out after We have taken possession of, and fully examined and cleaned the Vehicle at the end of the Rental Period.
Loss of Use means the fee calculated at the daily rate shown in the Rental Agreement being Our loss because the Vehicle needs repair and We are waiting for the repairs to be completed or it is a write-off or has been stolen and We are waiting for it to be replaced.
Off Road means any area that is not a legally designated road nor a sealed road nor an Unsealed Road and includes but is not limited to unformed roads, fire trails, tracks, river and tidal crossings, creek beds, beaches, streams, dams, rivers, flood waters, sand, deserts, rocks, fields and paddocks.
Overhead Damage means:
(a) Damage at or above the level of the top of the front windscreen of the Vehicle;
(b) Damage to any part of the pantech or box section of a Commercial Vehicle; or
(c) Third Party Loss,
caused by:
(i) contact between the part of the Vehicle that is at or above the level of the top of the front windscreen with objects overhanging or obstructing its path;
(ii) use of a Commercial Vehicle so that its height exceeds that permitted by law, by-law, regulation or advisory sign in the area of use;
(iii) objects being placed on the roof of the Vehicle; or
(iv) You or any person standing or sitting on the roof of the Vehicle.
Premium Location Surcharge (PLS) means the extra amount payable to Us when a Vehicle is hired from a premium location. The amount is shown in the Rental Agreement, is subject to GST and is adjusted when a DLF and, if applicable, an SVALF are payable.
Rental Charges means all rental and associated charges plus GST or other taxes and levies required by law, and credit card and vehicle registration recovery fees, all shown in the Rental Agreement.
Rental Station means the branch or rental location from which You hired the Vehicle.
Rental Period means the period shown in the Rental Agreement or as extended by Us.
Single Vehicle Accident means an Accident that occurs on an Unsealed Road where Unsealed Road Cover - 4WD or Unsealed Road Cover - ALWD have been purchased and the Accident does not involve an impact between the Vehicle and another moving vehicle. It includes but is not limited to:
(a) impacts with animals, roadside infrastructure, vegetation, rocks and obstacles;
(b) rollovers; or
(c) impacts with any stationary object, including other stationary parked vehicles.
Single Vehicle Accident Liability Fee (SVALF) means the amount payable to Us in the event of Damage or Third Party Loss arising from a Single Vehicle Accident and applies only if You have purchased Unsealed Road Cover - 4WD or Unsealed Road Cover - ALWD. The maximum amount payable is shown in the Rental Agreement, is additional to the DLF and is subject to GST.
Snow Cover means the additional cover that allows the Vehicle to be driven within a Snow Area.
Snow Area means any area where snow or ice has formed on the ground or any area where it is indicated, recommended or required that snow chains are to be fitted to the Vehicle.
Start of Rental means the date and time that the rental commences at the Rental Station shown in the Rental Agreement.
Third Party Loss means any loss or damage to third party property, including other motor vehicles, and any third party claim for loss of income or consequential loss.
Underbody Damage means any damage to the underside of the Vehicle and includes but is not limited to all parts of the drive train, chassis, steering, suspension, brakes, exhaust, floor pan and fuel systems.
Unsealed Road means a legally designated public road that has been formed and constructed but is not sealed with a hard material such as tar, bitumen or concrete.
Unsealed Road Cover - 4WD means the additional cover that allows some classes of Vehicle to be used on an Unsealed Road but it never allows the use of the Vehicle Off Road.
Unsealed Road Cover - ALWD means the additional cover that allows some classes of Vehicle to be used on an Unsealed Road that is graded and maintained by a local or government body, authority or council but it never allows the use of the Vehicle Off Road.
Vehicle means the vehicle described in the Rental Agreement and includes its parts, components, accessories, audio equipment and tools or any vehicle substituted by Us pursuant to the Rental Contract.
We, Us, Our means Europcar or one of its franchisees or affiliates as shown in the Rental Agreement.
You, Your means the person, firm, company or organisation renting the Vehicle or any Authorised Driver shown in the Rental Agreement.
Your Europcar Account means Your credit card, Europcar charge account or Debit Card nominated at the Start of Rental for the debiting of charges under the Rental Contract.
2.1 Your rental of the Vehicle from Us is for the Rental Period and at the rate shown in the Rental Agreement.
2.2 The Vehicle must be returned to the Rental Station, on the date and by the time shown in the Rental Agreement.
2.3 We understand that circumstances change and that You may require the Vehicle for longer than the Rental Period. If so, You must notify Us at least 2 hours prior to the expiration of the Rental Period.
2.4 If We have agreed to an extension of the Rental Period and Your extended Rental Period is longer than 30 days, Youmust take the Vehicle to Your nearest Europcar rental station on day 29 and every 30 days thereafter to pay Your additional Rental Charges for the extended Rental Period unless You have Our prior written agreement varying these conditions.
2.5 If You fail to notify Us at least 2 hours before the expiration of the Rental Period that You require an extension We may:
(a) terminate the Rental Contract; and
(b) recover the Vehicle by lawful means.
2.6 A ‘No Show' fee may apply if You fail to notify Us of Your intended cancellation prior to the date and time of the commencement of Your reservation.
2.7 We reserve the right to substitute a suitable replacement vehicle at any time.
3.1 At the Start of Rental You must pay Us the Rental Charges shown in the Rental Agreement unless You have Our prior written agreement that payment is to be billed to a corporate account or by fully paid voucher. Payment by Debit Card is not acceptable on all Vehicles.
3.2 When collecting and returning the Vehicle the primary cardholder must be present.
3.3 At the end of the Rental Period You must pay Us:
(a) the Rental Charges;
(b) all reasonable costs to return the Vehicle to the same condition it was in at the Start of Rental including but not limited to extra cleaning; and
(c) any amounts payable under clauses 3.8, 4.6 and 4.7.
3.4 If there is Damage or Third Party Loss You must pay Us:
(a) the DLF; and
(b) the SVALF where Unsealed Road Cover - 4WD or Unsealed Road Cover - ALWD have been purchased and a Single Vehicle Accident has occurred,
unless Your Rental Contract is for Customer Own Insurance in which case You are liable for all Damage or Third Party Loss.
3.5 If the DLF and SVALF are payable under clause 3.4 and there is no Third Party Loss:
(a) upon return of the Vehicle to the Rental Station We may make an estimate of Damage and charge Your Europcar Account the estimated amount up to but not exceeding the DLF and SVALF shown in Your Rental Agreement; and
(b) once Damage has been assessed We will;
(i) debit Your Europcar Account with the difference up to a total amount not exceeding the DLF and SVALF shown in Your Rental Agreement; or
(ii) credit Your Europcar Account with the difference;
and forward to You a tax invoice for the assessed amount.
3.6 If You have not paid the DLF and SVALF as required by clauses 3.4 and 3.5 You are in breach of the Rental Contract. You then have no cover and are liable for each of the items and amounts payable under clause 4.7.
3.7 The Vehicle is supplied with a full tank of fuel. If You do not take the "prepaid fuel" option and return the Vehicle without a full tank of fuel a refuelling charge will apply. You must also pay for any fuel used for the delivery and collection service.
3.8 You are liable for and must pay all infringement fees and any court fees or costs imposed for an infringement offence:
(a) where approved vehicle surveillance equipment has detected:
(i) a speeding offence;
(ii) an offence in respect of a failure to comply with the directions given by a traffic signal; or
(iii) a toll offence;
(b) arising from parking the Vehicle on any portion of a road in breach of any bylaw of a road controlling authority or Part 6 of the Land Transport (Road User) Rule 2004,
whether You were driving the Vehicle or not.
3.9 If We receive an infringement notice for an infringement offence from an enforcement or regulatory authority We will send You a copy of that notice or of any reminder notice as soon as practicable. You have the right to:
(a) challenge, complain about, query or object to the alleged offence to the issuing enforcement authority; and
(b) seek a Court hearing within 56 days from the date of the issue of the infringement notice or 28 days from the issue of the reminder notice.
3.10 If We receive a reminder notice for an infringement offence We may debit Your Europcar Account for the amount of the infringement fee and We may charge an administration fee if We do.
3.11 We may also supply Your details to any regulatory or enforcement authority upon its request and an administration fee applies if We do or if We have notified You of the receipt of an infringement notice from any such authority. If We have paid any amount for which You are liable under clause 3.8 You will also be charged that amount together with an administration fee.
3.12 All amounts payable under the Rental Contract are subject to subsequent verification and adjustment and details of any adjustments will be provided to You as soon as practicable. If a refund is due to You it will be credited to Your Europcar Account. If any amount is due to Us You authorise Us to charge Your Europcar Account with that amount, including the DLF, the SVALF and any amounts payable under clauses 3.8, 4.6 or 4.7. These charges may be made at any time during or after the end of the Rental Period.
3.13 If You hired the Vehicle from a premium location a PLS will apply.
3.14 If currency conversion is required for payment of amounts due to Us under the Rental Contract, We will apply the commercial exchange rate valid at the time We credit or debit Your Europcar Account.
3.15 If You fail to pay Us any amount due under the Rental Contract You must also:
(a) pay Us interest on that overdue amount calculated at the rate of 10% per annum and starting 7 days after the date that overdue amount became payable to Us and ending on the date of payment of all amounts due;
(b) pay the reasonable costs and charges We incur in recovering or attempting to recover that overdue amount, including mercantile or debt collection fees, commission and any legal costs.
4.1 The DLF and, if applicable the SVALF, each shown in the Rental Agreement must be paid if there is Damage or Third Party Loss unless Your Rental Contract is for Customer Own Insurance in which case You are liable for all Damage or Third Party Loss.
4.2 If Cover Products are purchased to reduce Your liability We will provide cover for Damage or Third Party Loss but Youmust pay the reduced DLF shown in the Rental Agreement.
4.3 The DLF and SVALF shown in the Rental Agreement are payable for each separate event and whether You are at fault or not.
4.4 The Rental Contract provides no cover for personal property owned by You, any unauthorised driver or any passenger even if Cover Products have been purchased.
4.5 If there is Damage or Third Party Loss and You have purchased:
(a) SPOM, which is Our premium cover, Your DLF liability is reduced to the amount shown in the Rental Agreement, which for some classes of Vehicle may be nil, and it includes WWI;
(b) SCDW, Your DLF liability is reduced to the amount shown in the Rental Agreement, which for some classes of Vehicle may be nil, but it does not include WWI;
(c) POM, Your DLF liability is reduced to the amount shown in the Rental Agreement, but never to nil and it includes WWI;
(d) LDW or CDW, Your DLF liability is reduced to the amount shown in the Rental Agreement but never to nil and it does notinclude WWI;
(e) WWI, there is cover for windscreen, headlight, wheel and tyre damage unless caused recklessly or by a deliberate, wilful or criminal act or by driver abuse, but there is no reduction in Your DLF and no cover for damage to side and rear windows
and each level of cover is subject to You not being in breach of the Rental Contract.
4.6 You must always pay and there is no cover for:
(a) the DLF if there is Damage or Third Party Loss;
(b) the SVALF if You have purchased Unsealed Road Cover - 4WD or Unsealed Road Cover - ALWD and there is Damage or Third Party Loss caused by a Single Vehicle Accident;
(c) the cost of rectifying windscreen, headlight, wheel or tyre, damage unless You have purchased SPOM, POM or WWI;
(d) Damage or Third Party Loss that occurs whilst a Commercial Vehicle is being driven in reverse;
(e) Damage that is caused to a Vehicle with a convertible roof by overfilling the luggage compartment above the recommended level, and then activating the convertible roof mechanism;
(f) Overhead Damage;
(g) Damage or Third Party Loss caused deliberately or recklessly by You, any unauthorised driver or any passenger of the Vehicle;
(h) Underbody Damage and any Damage linked to that Underbody Damage caused by contact between the underside of the Vehicle and any part of the road way or any object or obstruction including but not limited to kerbs, gutters, speed or road humps, barriers or wheel stops;
(i) Damage caused by total or partial inundation or immersion of the Vehicle in water or exposure of the Vehicle to salt water, including that which occurs whilst the Vehicle is being transported;
(j) Damage or Third Party Loss caused or contributed to by You or any driver where You or the driver leaves the scene of the Accident prior to the attendance of the police or reporting the Accident to the police;
(k) the full cost of replacing or repairing any accessories supplied by Us including, but not limited to child restraints and GPS units and lost keys;
(l) Damage caused by use of the incorrect fuel type;
(m) Damage or Third Party Loss if the Vehicle is taken into any area prohibited by the Rental Contract;
(n) property that is stolen from the Vehicle, lost or damaged during the Rental Period or left in the Vehicle after the Vehicle is returned to the Rental Station;
(o) loss or damage to Your property, the property of a member of Your immediate family or of an entity related to You, that arises from the use of the Vehicle; or
(p) Damage or Third Party Loss if Your Rental Contract is for Customer Own Insurance.
4.7 If You or any driver whether authorised by Us or not breach the Rental Contract there is no cover and You and any driver are each liable for:
(a) Damage;
(b) Third Party Loss;
(c) storage, repossession and recovery fees;
(d) roadside assistance; and
(e) administrative and legal costs of recovery,
even if Cover Products have been purchased.
5.1 If You have a Corporate Services Agreement with Us that provides for Customer Own Insurance and if Your Rental Agreement records that Your Rental Contract is for Customer Own Insurance:
(a) all Damage and Third Party Loss arising from the use of the Vehicle is Your responsibility and must be paid in full by You; and
(b) You fully indemnify Us for:
(i) Damage or Third Party Loss; and
(ii) any demand, claim, including a claim for legal costs, action or proceeding made, commenced or issued by or against You,
that arises from the use of the Vehicle.
6.1 In this section, We set out the responsibilities You have to Us when You hire one of Our vehicles. You should be aware that a failure to fulfill any of these responsibilities is a breach of the Rental Contract with the consequences that are set out in clause 4.7.
6.2 The Vehicle must only be driven by You.
6.3 You must:
(a) be no less than 21 years of age and additional charges will apply for specific vehicles and drivers under the age of 25;
(b) hold a full, current, unrestricted driving licence for the Rental Period valid and appropriate for the Vehicle and which is written in English or an international licence translated into English;
(c) allow Us to inspect Your licence at any time during the Rental Period; and
(d) fully inspect the Vehicle at the Start of Rental to ensure the condition of the Vehicle and any pre-existing damage is accurately noted and shown in the Rental Agreement. If there is any discrepancy, You must notify Us prior to leaving the Rental Station;
6.4 During the Rental Period You must:
(a) take all reasonable care of the Vehicle:
(i) to prevent Damage;
(ii) to ensure that the Vehicle is not overloaded by the number of persons or by the weight of goods carried;
(iii) by using any security device fitted to or supplied with the Vehicle; and
(iv) by protecting the Vehicle against inclement weather;
(b) keep the Vehicle locked and the keys under Your personal control at all times. You must be able to produce those keys in the event of a theft of the Vehicle;
(c) maintain all of the Vehicle's engine and brake oils, engine coolant levels and tyre pressures;
(d) use the correct fuel type;
(e) comply with all seat belt laws and fines may be imposed on any driver or passenger who does not have a seat belt properly adjusted and fastened;
(f) comply with all child restraint laws and ensure that the restraint has been fitted correctly according to the age of the child and that the restraint is properly adjusted and fastened;
(g) return the Vehicle and any accessories supplied by Us including, but not limited to, child restraints and GPS units in the same condition as at the Start of Rental;
(h) adhere to any mileage instructions displayed in the Vehicle or set by the Rental Station; and
(i) immediately upon request provide Us and any regulatory or enforcement authority Your full, accurate and up-to-date information relating to the use of the Vehicle during the Rental Period;
(j) ensure that a copy of the Rental Contract is kept in the Vehicle throughout the Rental Period; and
(k) produce a copy of the Rental Contract without delay for inspection on demand by an enforcement officer.
6.5 You must never:
(a) use the Vehicle when it is damaged or unsafe;
(b) drive or operate the Vehicle:
(i) whilst under the influence of alcohol or drugs or both to such an extent that You are incapable of having proper control of the Vehicle; or
(ii) whilst You have a blood alcohol content or level of drugs present in Your blood that exceeds the limit permitted by law.
(c) allow the Vehicle to be driven or operated in circumstances that constitute an offence against sections 56, 57, 57A or 58 of the Land Transport Act 1998;
(d) fail or refuse to undergo any breath or blood test or drug impairment assessment;
(e) drive the Vehicle whilst Your driving licence is subject to any restriction or condition;
(f) commit:
(i) any willful, deliberate or criminal act, including an act of driver abuse;
(ii) an act of connivance with any person acting for You or on Your behalf, that causes Damage;
(g) drive the Vehicle dangerously or recklessly;
(h) use a mobile phone or a GPS unit whilst the Vehicle is in motion or stationary but not parked unless the body of the phone or GPS unit is affixed to the Vehicle and the phone or GPS unit is not being held or touched at any time whilst being used;
(i) leave the keys to the Vehicle in it or with it whilst it is unattended or unoccupied by You or any passenger;
(j) leave the Vehicle unattended following an Accident and before the arrival of a tow or salvage operator;
(k) modify the Vehicle in any way and no roof racks or towbars are permitted unless fitted by Us;
(l) use or allow the Vehicle to be used for the transport of passengers for hire, fare or reward unless You have Our prior written authority for use of the Vehicle in a passenger service licensed under Part 4A of the Land Transport Act 1998;
(m) use the Vehicle for off-roading, reliability trials, a race, rally or contest, speed testing, driving instruction, to propel or tow another vehicle, in violation of any legislation, order or regulation affecting the use, loading or condition of the Vehicle, or for any illegal purpose;
(n) use the Vehicle for transporting any animals, unless specifically approved by Us. Additional cleaning charges may apply and will be shown in the Rental Agreement;
(o) use the Vehicle to carry dangerous goods as defined by the Land Transport Rule: Dangerous Goods 2005
(p) sell, rent, sublet, dispose of, or hire the Vehicle to any other person.
(q) allow the Vehicle to be operated outside Your authority or by any person who is not an Authorised Driver;
(r) operate the Vehicle or allow it to be operated in breach of the Land Transport Act 1998, the Transport Act 1962, Land Transport (Road User) Rule 2004, or any other Act, regulations, rules, or bylaws relating to road traffic; or
(s) operate the Vehicle or allow it to be operated for the transport of more than the number of passengers or more than the gross vehicle mass specified in the certificate of loading for the Vehicle;
6.6 You and any passengers must not smoke in the Vehicle. Additional cleaning charges will apply if there is a breach of this condition.
6.7 Parts of New Zealand are not suitable for access by rental vehicles. To prevent damage to the Vehicle and for Your own personal safety We strictly enforce conditions that restrict Your use of the Vehicle.
6.8 Unless We have given Our prior written consent, You must never take the Vehicle:
(a) on any Unsealed Road unless Unsealed Road Cover - 4WD or Unsealed Road Cover - ALWD has been purchased;
(b) within a Snow Area unless Snow Cover has been purchased.
6.9 Even if Unsealed Road Cover - 4WD or Unsealed Road Cover - ALWD has been purchased You must never take the Vehicle:
(a) Off Road;
(b) between the North and South Islands in either direction or onto any island that is off mainland New Zealand;
(c) through any river, stream, creek or tidal crossing;
(d) through flood waters or on flood prone roads or on any road where the state or condition of the road make the use of the Vehicle unsafe;
(e) on any road where the police or any government or statutory authority has issued a warning, caution or which has been closed;
(f) onto any road where We have notified You that the use of the Vehicle is prohibited;
(g) on the following roads:
(i) Ball Hutt (Mt Cook);
(ii) Skippers (Queenstown); or
(iii) 90 Mile Beach (Northland);
(h) on all roads north of Colville on the Coromandel Peninsula, the Tapu to Coroglen road (all parts east of Rapaura Gardens), the 309 road from Coromandel to Kairnarama and the Blackjack Road from Kuatuna and Opito; or
(i) on the following highways on the South Island between the hours of 2200 and 0600 (local time) from 1 April until 31 October:
(i) State Highways 6 and 8 between Twizel and Queenstown;
7.1 When You make a reservation with Us We will provide a Vehicle that is reasonably fit for the purpose for which You have hired the Vehicle and is in good working order.
7.2 If the Vehicle breaks down during the Rental Period because of Our negligence or wilful default We recover and repair the Vehicle will as soon as possible. If the Vehicle cannot be repaired, We will use Our best endeavours to provide a replacement Vehicle of an equivalent size and standard to the previous Vehicle for the remainder of the Rental Period.
7.3 If it is not possible to conduct an inspection of the Vehicle with You at the end of the Rental Period We will use Our best endeavours to confirm the condition of the Vehicle with You within 4 working hours of the Final Inspection.
7.4 We are only responsible for any direct loss that You suffer as a result of Our breach of the Rental Contract. We are not responsible for missed flights, disrupted travel or holiday plans, loss of enjoyment or opportunity, indirect or consequential loss.
8.1 Inherent mechanical faults in the Vehicle receive free roadside assistance.
8.2 Fees and charges apply for all other faults or driver induced errors, including but not limited to:
(a) incorrect refuelling;
(b) a flat battery;
(c) lost keys;
(d) keys locked in the Vehicle;
(e) tyre changing other than as a result of a tyre puncture; or
(f) racks and chains broken by incorrect fitting to the Vehicle by You
8.3 We reserve the right not to replace the Vehicle if it is involved in a major Accident or there has been major Damage or You have breached the Rental Contract.
8.4 If:
(a) a warning light appears; or
(b) You see or become aware of low engine or brake oils, engine coolant levels or tyre pressures; or
(c) the Vehicle develops any fault during the Rental Period,
You must inform Us immediately via the contact details in the Vehicle and in the Rental Agreement and not use the Vehicle unless We have authorised You to do so. If You fail to notify Us and continue to use the Vehicle You will be responsible for any Damage.
8.5 You must not let anyone work on the Vehicle or arrange or undertake any repairs to the Vehicle or towing or salvage of it unless We have given You Our prior authority. You must keep and produce to Us the original tax invoices and receipts for any repairs, towing or salvage and You will be reimbursed only if these expenses have been authorised by Us. Any entitlement to reimbursement is subject to there being no breach of the Rental Contract.
8.6 You must immediately report any Accident or theft of the Vehicle to Us in writing and complete all documentation that We require and forward any third party correspondence or court documents to Us within 7 days of receipt.
8.7 If You have an Accident in which:
(a) a person is injured;
(b) the other party failed to stop or exchange details;
(c) the Vehicle or any other vehicle is towed; or
(d) a driver appears to be under the influence of intoxicating liquor or drugs;
a report must also be made to the police immediately.
8.8 If the Vehicle is stolen a report must be made to the police immediately the theft is discovered.
8.9 If You have an Accident You must also:
(a) make the Vehicle secure;
(b) get the names and addresses of all persons involved, including witnesses;
(c) supply Us with any information concerning the driver of the Vehicle and You must allow Us direct access to the driver of the Vehicle and You must fully co-operate in allowing Us to gain such access;
(d) not make or give any offer, promise of payment, settlement, waiver, release, indemnity or admission of liability;
(e) permit and assist Us to bring, defend, enforce or settle any legal proceedings against a third party, including attending at a lawyer's office and/or court; and
(f) allow Us to claim in Your name under any applicable substitute vehicle insurance, and do everything that maybe required to assist Us in making such a claim.
9.1 At the end of the Rental Period, in addition to Your obligations under clauses 3.3, 3.4 and 3.5, You must return the Vehicle to Us:
(a) to the Rental Station;
(b) in the same condition it was in at the Start of Rental; and
(c) at the date and time set in the Rental Agreement.
9.2 We allow a grace period of 30 minutes for the return of the Vehicle but if it is returned to Us more than 30 minutes after the time set for its return in the Rental Agreement You will be charged one full day's extra rental. Standard daily rates will apply if the Vehicle is returned to Us more than 24 hours after the time set for its return in the Rental Agreement unless the Rental Contract has been extended by Us. You will also be liable for any repossession charges, Damage or any costs We incur.
9.3 If You return the Vehicle to a rental station other than that shown in the Rental Agreement, or when the Rental Station is closed, or any place other than a Europcar rental station:
(a) a one way fee may apply;
(b) You will be deemed to have returned the Vehicle only after the Final Inspection of it has been conducted by Us; and
(c) the Rental Charges will continue and You will be responsible for Damage and Third Party Loss until that Final Inspection.
9.4 If a bond that has been prepaid to Us It is fully refundable to You provided that at the end of the Rental Period:
(a) all amounts due to Us under the Rental Contract have been paid;
(b) the Vehicle has been returned to the Rental Station at the date and time set in the Rental Agreement;
(c) there is no Damage or Third Party Loss;
(d) the interior and exterior are clean;
(e) the Vehicle has a full tank of fuel; and
(f) the Rental Contract has not been breached.
We reserve the right to retain all or part of a bond if there is a breach of any of these conditions.
9.5 If We terminate the Rental Contract it will not affect Our right to receive any money We are owed under the Rental Contract. We can also claim reasonable costs from You if You do not meet any of the requirements of the Rental Contract.
10.1 We may terminate the Rental Contract and take immediate possession of the Vehicle if:
(a) You breach the Rental Contract; or
(b) a reckless breach of road or traffic legislation has taken place.
10.2 If the Rental Contract is terminated by Us You must pay for:
(a) Damage;
(b) storage, repossession and recovery fees;
(c) roadside assistance;
(d) administrative and legal costs of recovery; and
(e) all reasonable costs and charges under the Rental Contract.
10.3 If We have terminated the Rental Contract You give Us permission to access and enter Your premises to repossess the Vehicle without using unreasonable force or causing damage.
11.1 The laws of New Zealand govern the Rental Contract.
11.2 The Insurance Law Reform Act 1977 applies to the Rental Contract which means that any exclusion clause in these Terms and Conditions will not apply if You prove on the balance of probabilities that Damage was not caused or contributed by the matters referred to in that clause.
12.1 If You believe there has been an error in Your account or if You have any complaint, Our staff at the Rental Station will help You in every way they can to rectify the error or resolve the complaint. If they are unable to assist You or if Your concerns are not resolved to Your satisfaction You may refer the matter to Our internal dispute resolution (IDR) process.
12.2 Upon receipt of Your referral to IDR Our IDR officer will acknowledge receipt of Your referral and will investigate the matter and try to reach a satisfactory outcome.
12.3 We will advise You of the final outcome of Your IDR referral within 45 days of receipt of that referral and We will use Our best endeavours to do so within 21 days thereof.

14.2 If You are a Privilege Loyalty Program member these Terms and Conditions must be read in conjunction with the General Terms and Conditions of that program.
14.3 In the event of any inconsistencies or ambiguity between the terms of Your corporate account, Your Corporate Services Agreement, Your Customer Own Insurance agreement or Your Privilege Loyalty Program, these Terms and Conditions will prevail.

A full and valid driving licence must have been held for a minimum of 12 months. The new style UK driving licence must be accompanied by its counterpart. The paper counterpart is never acceptable on its own, both parts need to be presented at the rental station when collecting the car or van as stated in Europcar standard terms and conditions.
With the prior consent of Europcar, the car or van may be driven by other persons. All drivers must meet the standard Europcar Qualifications, shown above. An additional driver(s) charge may be levied.
All prices include VAT unless otherwise stated.
All rentals are subject to a standard £250 deposit at the time of rental in addition to the appropriate rental charges. These funds will be Authorised* only on all payment types except switch & solo where the card will be charged and refunded after the rental period. Cheques will be cashed.
*Authorised means that the amount is 'marked' against the card but not actually charged to it. The Authorisation therefore reduces the cardholder's available credit as against their approved limit. The amount does not appear on the customer's monthly statement.

Cash / Cheques Payments:
Are only possible for certain vehicle categories at certain locations.
Cash and cheque deposits will be refunded depending on the condition of the car or van when you return it to us. Cash deposits will be refunded immediately if there are sufficient funds on site. If not a cheque will be sent to the renter at the address shown on the rental agreement. A cheque refund of the deposit, if appropriate, will be sent by Europcar within 10 working days by second class mail to the address shown on the rental agreement.
Note: Refunds may take up to 10 working days to credit in to your bank account/ credit card account.
Collision Damage Waiver

Are there any exclusions? Please refer to customer information guide which can be requested at time of pick up.
If you are an in inbound customer into the UK and you choose to use the cover provided by your credit card, you are responsible for compensating Europcar for any damage and or loss of the vehicle and accessories and reclaiming this from your credit card company.
Any inbound Customers declining our Collision Damage Waiver or Theft Waiver will be required to complete a declaration to that effect.

Overseas Charge
The Overseas Charge is applicable to all customers travelling to the countries listed in Section 1 and Section 2 and is a one-off fee of £64.99 inc VAT. The Overseas Charge is payable on collection of the car or van or the VE103B (see below) form which ever is later. The Overseas Charge is applied for the provision of the VE103B document and the Green Card, if appropriate, and RAC European Motoring Assistance.
SECTION 1 - EU Countries (including Southern Ireland), Jersey, Guernsey, Isle of Man, Norway, Switzerland, Iceland, Liechtenstein, Gibraltar, Andorra and San Marino
All cars and vans may travel to the countries in Section 1 provided the driver is carrying a valid VE103B form. A Green Card is not necessary.
A VE103B form is the ONLY valid document giving owners permission to take the vehicle outside of mainland UK and acts as a duplicate of the Vehicle Registration Document. No letters or other documents should be used.
The VE103B form is provided by the rental station at time of pick up or later by arrangement.
SECTION 2- All countries which are NOT listed in Section 1
Cars and vans are allowed to travel to countries in Section 2 at the discretion of our insurance company. All rentals travelling to these countries should contact our Insurance Department at Leicester 011162492702 for authorisation and the issue of a Green Card.
Please Note: At least 5 working days notice must be given if you are travelling to a country in Section 2, and there will be an additional charge levied at the discretion of Europcar's Insurers. Please note that without the correct documentation, you could be turned back from the border or may be subject to and liable for a considerable charge.
RAC European Motoring Assistance
Customers taking a car or van abroad (including trips to Southern Ireland) must have cover to ensure that both they and the car or van can be recovered in the event of the car or van becoming un-drivable as the result of an accident or through mechanical failure. THERE IS A SINGLE LEVEL OF COVER IRRESPECTIVE OF DESTINATION OR LENGTH OF RENTAL.
Europcar is working with UK's law enforcement bodies to help reduce identity theft, vehicle theft and money laundering by asking renters at certain locations and all consumer deliveries to provide a thumbprint on the Rental Agreement on the delivery of the car or van. When the car or van is returned, renters' thumbprints will be destroyed as part of our routine process.
All vehicles are supplied with a full tank of fuel at start of rental. Renters can choose from 3 re-fuelling options which will be advised at the start of the rental and are briefly described below. Fuel prices are checked and updated weekly according to the national average forecourt price. Fuel used when delivering and/or collecting a rental car or van to and/or from you is the renter's responsibility.
Full to Full - If the car or van is returned with a full tank, no refuelling service charge will apply.
Full Tank Option - With this option, fuel is pre-paid at the start of the rental (at 10p per litre less than the national average**) and re-fuelling is not necessary on return. No refunds are given for unused fuel at the end of the rental, but a £10 unused fuel voucher will be given if there is more than ¼ tank left on return redeemable against your next rental.
For customers renting for 4 days or more, this option is recommended.

Re-fuelling - If the car or van is not returned with a full tank of fuel or the Full Tank Option is not purchased, Europcar will provide a re-fuelling service the car for you at our standard re-fuelling service charge (which includes the cost of the fuel) of 65p per litre (net of VAT) above the national average.
Any property placed in the car or van is at your own risk and Europcar takes no responsibility for it. You must check you have not left any personal property in the car or van before you return it back to Europcar Any unclaimed property will be disposed of 3 months after the end of the rental period.
Before your hire commences we will verify your identity by carrying out a check using Experian's Authentication check. If there is an unsatisfactory search result you will need to provide paper-based proof of identity such as a utility bill or bank statement etc that is less than 4 months old at the delivery of the vehicle or when you pick up the vehicle from the Rental Station.

This Agreement sets forth the conditions on which Europcar will provide you the services offered through the tepwireless.com website ("the Website"). This Rental Agreement is a contract between you and Europcar ("Company").
Nature of services
Company provides a wireless modem rental service (the "Mobile Wi-Fi"), along with user guides and accessories (collectively the "Equipment") to travelers who plan to visit the United Kingdom. We do not offer Equipment for sale.
Eligibility to rent equipment
While the Equipment may be used by travelers of any age, we can only rent to adults who are at least 18 years of age, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Rental Agreement, and to abide by and comply with the terms set forth herein.
Use of equipment
You agree to exercise reasonable care in the use of all Equipment, and to handle all Equipment in accordance with the user guide. You further agree that you will not do any of the following: (a) make repairs or modifications, or alter in any way, the Equipment; (b) remove or alter any certification markers affixed to the Equipment; (c) share the Equipment with any third party, or allow any such third party to use the Equipment, with the sole exception of a family member, companion, or friend accompanying you on your trip; (d) dispose of the Equipment; (e) grant any interest in the Equipment to any third party; or (f) use the Equipment for any illegal purpose.
Returns
You must return the Equipment before your departure from the UK to the Europcar rental station which rented you the Equipment in the first place.
Fees and charges
(a) Rental Charges. Rental fees for the use of our Equipment are assessed commencing as of the Rental Start Date and ending as of the postmarked date on which the Equipment is returned. (b) Service Charges. Usage charges must be pre-paid according to the current data rate schedule agreed. Please note that we are unable to offer the same rates in Europe that we are able to offer in the United Kingdom. (c) Charges for Damage to the Equipment. You are solely responsible for all loss or damage to the Equipment during the Rental Period. We will bill any charges for damage at our discretion or in the alternative bill them directly to your credit card. Charges for the loss of the Equipment will be billed to a credit card as set forth in this Agreement. (d)Late Fees. Failure to return the Equipment (including all accessories and user guides) promptly will result in the incurrence of additional late charges. In the event that we fail to receive the Equipment, or any portion of the Equipment, seven (7) days after the rental end date, you will be incur a daily penalty fee until the date the Equipment is received..If for any reason you are unable to return the Equipment to us, including but not limited to the Equipment being lost or stolen during the Rental Period, then you should contact us immediately, so that you do not incur additional late charges. The replacement price will be GBP 100 including VAT .The Company will not accept replacement devices as a substitute for any of these fees. In the event of a lost pocket Wi-Fi, any remaining balance on the account cannot be refunded, as it is linked with the SIM card. Please note that we reserve the right to institute collection procedures against you in the event that you fail to return our Equipment to us as required by this Rental Agreement or fail to pay any service or damage charges or late fees that you incur. If it becomes necessary for us to institute collection procedures against you, you agree to pay our costs of collection, including without limitation reasonable attorneys' fees. Any late fees that we collect will not waive any other right or remedy that may otherwise be available to you under this Agreement.
Ownership of equipment
By using this service, you agree and acknowledge you are renting Equipment for travel purposes only, and that you will acquire no rights in the Equipment. You agree that Fonmigo Ltd will retain all ownership of the Equipment, including but not limited to user guides and accessories.
Customer warranty
If you are renting this Equipment on behalf of an entity rather than for your own personal use, then you represent and warrant that you are fully authorized to enter into this Agreement on behalf of such entity, and to bind such entity to the terms and conditions set forth in this Rental Agreement. You further represent and warrant that you are not committing any fraud or misrepresentation in entering this Rental Agreement.
Company warranty
Company warrants that the Equipment will be delivered in good working order and condition, and that it will continue to operate properly during the term of the Rental Period.
Remedies
In the event of any failure to meet the Company Warranty, our sole liability and your sole and exclusive remedy will be to repair or replace the Equipment at our expense. If we replace the Equipment, you will receive the same or reasonably similar Equipment to use for the remainder of the Rental Period. It is your obligation to notify us immediately in the event that you experience any problem with your Equipment.
Disclaimer of warranties
Except for the warranty set forth above, company makes no representations, warranties, conditions, or guaranties, whether express, implied, statutory, or otherwise, oral or written, regarding the equipment or this rental agreement. we make no endorsements regarding any third party listed in our user guide, and cannot warrant or make any representation about the quality of their services. we cannot warrant our equipment will operate uninterrupted or error-free, that it will operate properly on all wireless networks, that it will meet all of your needs, or that any third party services that you access through the user guide will be uninterrupted, error-free, or meet your needs. we cannot be responsible for the legality, adequacy, accuracy, quality, or operation of any third party services. company expressly disclaims all other warranties with respect to the equipment, our rental services, and any third party services accessed through our user guide, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement of third party rights. you assume sole and exclusive responsibility for the use of the equipment and for any reliance on any third party services. while we will make every effort to erase all personal information left on returned equipment, we cannot be responsible for ensuring the protection of personal information left on returned equipment. you assume the sole risk and responsibility for erasing personal information prior to returning equipment rented pursuant to this rental agreement.
